Where it stands
As of the JPML report dated September 1, 2026, 3,925 actions remain pending in MDL 2741 before Judge Vince Chhabria in the U.S. District Court for the Northern District of California, with tens of thousands more cases in state courts. Most current litigation traces to a 2020 Bayer settlement program that Bayer says resolved roughly 75% of then-existing claims for a total of $10.1 billion to $10.9 billion; new cases have continued to be filed since. On June 25, 2026, the U.S. Supreme Court ruled 7-2 in Monsanto Co. v. Durnell that the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) preempts state-law failure-to-warn claims premised on the theory that Roundup's EPA-approved label should have carried a cancer warning; the ruling does not necessarily bar other theories such as design-defect or manufacturing-defect claims. Separately, a proposed $7.25 billion nationwide class settlement (King v. Monsanto, Missouri Circuit Court, City of St. Louis) received preliminary approval on March 4, 2026; a final approval hearing, originally set for July 9, 2026, was pushed to September 14, 2026 after the settlement administrator reported an influx of class members trying to revoke earlier opt-outs following the Durnell ruling. What the lawsuits are about
Roundup is a glyphosate-based herbicide originally developed by Monsanto and now sold under Bayer ownership (Bayer acquired Monsanto in 2018). Plaintiffs allege that exposure to glyphosate in Roundup causes non-Hodgkin lymphoma (NHL) and that Monsanto knew or should have known of the cancer risk and failed to warn users. Monsanto and Bayer deny that Roundup causes cancer and point to the U.S. Environmental Protection Agency's conclusion that glyphosate does not present a human health risk when used according to label directions; plaintiffs point to the World Health Organization's International Agency for Research on Cancer (IARC), which classified glyphosate as 'probably carcinogenic to humans' in 2015.
The Judicial Panel on Multidistrict Litigation centralized federal Roundup product liability cases into MDL No. 2741, In Re: Roundup Products Liability Litigation, in the U.S. District Court for the Northern District of California before Judge Vince Chhabria.
