Where it stands

MDL 3094 is in the pretrial motion phase. Judge Karen S. Marston is overseeing a Rule 702 (Daubert) hearing on expert testimony about warnings, preemption, and general causation held September 10 to 18, 2026, following Case Management Order No. 30 (January 14, 2026), which set up a streamlined docket for resolving those cross-cutting issues before any bellwether trials are scheduled. In August 2025, Judge Marston ruled that plaintiffs alleging gastroparesis must produce an objective gastric emptying study, breath test, or wireless motility capsule result showing delayed gastric emptying; symptom-only claims do not meet the diagnostic bar. Vision-loss (NAION) claims were carved out of this MDL and centralized separately as MDL 3163 in December 2025. No settlement has been reached and no claims process exists.

What the lawsuits are about

GLP-1 receptor agonists are prescribed for type 2 diabetes and, at higher doses, for chronic weight management. They work by slowing gastric emptying and increasing insulin release. Plaintiffs allege that Novo Nordisk (maker of Ozempic, Wegovy, and Rybelsus) and Eli Lilly (maker of Mounjaro, Zepbound, and Trulicity) knew or should have known these drugs could cause gastroparesis (stomach paralysis), ileus, and intestinal obstruction, and that the companies did not adequately warn patients and prescribers of that risk.

the U.S. Judicial Panel on Multidistrict Litigation centralized the gastrointestinal-injury cases into MDL No. 3094, In re: Glucagon-Like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, on February 2, 2024, transferring actions to the Eastern District of Pennsylvania before Judge Karen S. Marston. The transfer order covered claims involving Ozempic, Wegovy, Rybelsus, Trulicity, and Mounjaro; Victoza and Saxenda were later added as tag-along products. Plaintiffs filed a consolidated master complaint on November 13, 2024, asserting claims including failure to warn, design defect, fraud and misrepresentation, breach of warranty, negligence, and wrongful death.

As of September 2026 the litigation has not reached a trial or settlement. The court is resolving general-causation and warning-adequacy issues through expert (Daubert) challenges before any bellwether trials are picked, with the Rule 702 hearing held in mid-September 2026. Separately, claims alleging NAION (a form of sudden vision loss) were split out of MDL 3094 and centralized as a new MDL 3163 in the same court in December 2025, growing from 86 cases in May 2026 to roughly 200 by mid-2026.
