Both settlements are approved and closed to new claims. Subscriber payments began going out from May 11, 2026; provider claims have been in rolling review since February 16, 2026. Blue Cross Blue Shield antitrust settlement update — September 2026
What changed this month: in the September 1, 2026 report, MDL 2406 held at 22 pending actions, unchanged from the previous report. Figures come from the Judicial Panel's own monthly report and are restated here each month.
This is one antitrust case with two settlement classes, and almost every question people ask about it comes from confusing the two. The Subscribers Settlement resolved claims by people and employers who bought Blue Cross or Blue Shield coverage: a $2.67 billion fund, roughly $1.9 billion after fees and costs, with a claim deadline of November 5, 2021. Its administrator states that the initial distribution of payments to Damages Class Members with valid claims is being sent starting May 11, 2026. The Providers Settlement resolved claims by doctors, hospitals and other healthcare providers: a $2.8 billion fund, finally approved on August 19, 2025 and effective September 19, 2025, with a claim deadline of July 29, 2025. Its administrator began issuing claim acknowledgement notices on February 16, 2026 and continues to evaluate claims on a rolling basis. Neither settlement is accepting new claims. The underlying MDL remains open in the Northern District of Alabama for the parts of the case that were not settled.

What the lawsuits are about
Blue Cross Blue Shield is not one insurer. It is an association of independent member plans that license the Blue Cross and Blue Shield brands. The lawsuits alleged that the licensing rules were an illegal restraint of trade: the plans agreed to divide the United States into exclusive "Service Areas" and not to compete with each other inside them, and further agreed to limit how much business any plan could do outside the Blue brands. Plaintiffs said the effect was higher premiums for subscribers and lower reimbursement for providers than competition would have produced.
The cases were centralised as MDL 2406 in the Northern District of Alabama in 2012. They produced two distinct settlement classes with genuinely different interests. Subscribers — individuals, employers and their employees who bought the coverage — settled first, for $2.67 billion. Healthcare providers — the doctors, hospitals and practices paid by those plans — settled separately and later, for $2.8 billion.
Both settlements also included non-monetary terms aimed at the conduct itself, including changes to the Association's rules on national accounts and on how much non-Blue business a member plan may write.
The two settlements are administered by different claims administrators on different websites. bcbssettlement.com is the subscriber settlement; bcbsprovidersettlement.com is the provider settlement. A subscriber cannot check a claim on the provider site, and vice versa. Getting this wrong is the single most common reason people conclude their payment is missing.

Who the filings say qualifies
Eligibility was fixed by the class definitions and both claim windows have closed. These are the criteria that determined who could file, which is what someone checking an existing claim or a payment notice needs to confirm which settlement they are in.
- Subscribers Settlement, Damages Class: individuals, insured groups and their employees who purchased or were enrolled in a Blue Cross or Blue Shield health insurance or administrative services plan between February 7, 2008 and October 16, 2020.
- Subscribers Settlement, self-funded accounts: a shorter class period of September 1, 2015 to October 16, 2020.
- Subscribers Settlement claim deadline: November 5, 2021. Closed.
- Providers Settlement: persons and entities that provided healthcare services, equipment or supplies and were paid by, or entitled to payment from, a Settling Individual Blue Plan during the class period.
- Providers Settlement claim deadline: July 29, 2025. Closed. The administrator states that any new claims submitted are untimely and may not be honoured or reviewed.
- Neither settlement requires a lawyer, and neither is accepting new claimants. Existing claimants deal directly with the relevant administrator.

Questions people ask
When is the Blue Cross Blue Shield settlement payout date?
It depends which settlement you are in, and that is why answers on this vary so much. For the Subscribers Settlement, the administrator states that the initial distribution of payments to Damages Class Members with valid claims is being sent starting May 11, 2026, and that it cannot give an exact date for any individual payment. For the Providers Settlement, there is no announced distribution date: the administrator began issuing claim acknowledgement notices on February 16, 2026 and is still evaluating claims on a rolling basis. Those are the dates each official administrator publishes, read on September 10, 2026. Anybody quoting a single payout date for "the Blue Cross settlement" is merging two different settlements.
Are there really two Blue Cross Blue Shield settlements?
Yes, and they are separate in every practical way. The Subscribers Settlement ($2.67 billion) is for people and employers who bought Blue Cross or Blue Shield coverage. The Providers Settlement ($2.8 billion) is for doctors, hospitals and other healthcare providers who were paid by those plans. Different claim deadlines, different administrators, different websites, different timelines. They come from the same antitrust case, MDL 2406, which is why they are so often confused.
Which Blue Cross settlement website do I use?
If you bought or were enrolled in the insurance, you are a subscriber: bcbssettlement.com. If you provided healthcare services and were paid by a Blue plan, you are a provider: bcbsprovidersettlement.com. Checking a claim on the wrong site returns nothing, which is a common reason people believe their claim has vanished. We do not host either claim process and cannot look up a claim.
How do I check my Blue Cross Blue Shield claim status?
On the subscriber side, bcbssettlement.com has a "Check my Claim Status" page and asks for your Claim Number or Unique ID. On the provider side, claimants log in to their portal account at bcbsprovidersettlement.com, where the administrator posts claim notices; the administrator can also be reached at Administrator@BCBSProviderSettlement.com or (888) 452-3095. Those are the official routes. No third-party site can check a claim for you.
Can I still file a Blue Cross Blue Shield claim?
No. Both windows have closed. The Subscribers Settlement claim deadline was November 5, 2021 and the Providers Settlement claim deadline was July 29, 2025. The provider administrator states plainly that new claims submitted now are untimely and may not be honoured or reviewed. If you already filed, your claim is still live and is handled by the relevant administrator.
How much is the Blue Cross Blue Shield settlement?
The Subscribers Settlement fund is $2.67 billion, which the settlement's own FAQ puts at approximately $1.9 billion as a Net Settlement Fund after attorneys' fees, costs and administration are deducted. The Providers Settlement fund is $2.8 billion. What any individual claimant receives depends on their claim type and the number of valid claims, and neither administrator publishes a per-person figure.
I got a prepaid card email from the Blue Cross settlement. Is it real?
The subscriber administrator states that Damages Class Members who asked to be paid by prepaid card receive an email from distribution@BCBSsettlement.com during May with instructions to redeem the card, and that the official redemption site is settlementpayment.choicepaymenthub.com. Check the sender address and the destination domain against those before entering anything. Settlement distributions are a well-known pretext for phishing, and neither administrator will ask for payment to release your funds.
What was the Blue Cross Blue Shield lawsuit actually about?
Antitrust. Blue Cross Blue Shield is an association of independent licensed plans rather than a single insurer, and the plaintiffs alleged the licensing rules amounted to an agreement not to compete: the country was divided into exclusive Service Areas, and member plans were limited in how much non-Blue business they could write. Subscribers said this inflated premiums; providers said it suppressed what they were paid. The settlements also changed some of those rules going forward.
Is the Blue Cross Blue Shield MDL over?
Not entirely. MDL 2406 was still listed on the Judicial Panel's September 1, 2026 report with 22 actions pending in the Northern District of Alabama, out of 110 that have been in the docket historically. The two settlements resolved the classes they covered; the docket remains open for what they did not.
